These Terms of Service (the "Terms") set out the conditions for using the mobile application "PosePause" (the "App") provided by KARYUDO LLC (the "Company"). By downloading or using the App, you are deemed to have agreed to these Terms.
Article 1 (Application)
These Terms apply to all relationships between you and the Company concerning your use of the App. The App is distributed through Apple Inc.'s App Store and Google LLC's Google Play. If you obtained the App via the App Store, Apple's "Licensed Application End User License Agreement" also applies; if you obtained it via Google Play, the Google Play terms also apply. In the event of any conflict between those terms and these Terms, these Terms shall prevail with respect to matters specific to the App.
Article 2 (Overview of the App)
The App works together with iOS Screen Time (Screen Time / Family Controls) or the corresponding app-usage management features on Android to restrict the use of designated apps, and lets you lift those restrictions by performing camera-based exercises (squats, push-ups, yoga, and so on).
Article 3 (Health and Exercise Disclaimer)
Important: The App is not a medical device and is not intended to diagnose, treat, prevent, or improve any health condition. Always exercise within the limits of your own physical condition and ability.
You perform the exercises presented by the App (including yoga poses, squats, and the like) at your own responsibility and discretion.
If you have heart disease, high blood pressure, joint disorders, or other chronic conditions, are pregnant, have any injury or pain, or otherwise have concerns about exercising, consult a physician before using the App.
If you feel pain, dizziness, shortness of breath, or any other abnormality during exercise, stop immediately. Do not force unnatural postures or excessive repetition.
Exercise only after securing a safe environment (adequate surrounding space, a non-slip floor, and so on).
To the maximum extent permitted by law, the Company shall not be liable for any bodily injury, health damage, or other loss arising from or in connection with your use of the App.
Article 4 (Disclaimer Regarding the App-Restriction Feature)
The App's locking and restriction features rely on iOS Screen Time or the corresponding Android features, and their behavior depends on the specifications of Apple and Google and on the state of the OS.
Due to the design of iOS, there may be a delay of several minutes in tallying usage time and applying restrictions, and the Company does not guarantee that restrictions will be applied instantly or reliably.
The App may create a state in which you cannot access certain apps or notifications. The Company is not liable if, as a result, you miss important communications, work, or emergency information. You are responsible for choosing which apps and time limits to restrict.
The features may not operate correctly due to OS updates, changes to device settings, or other factors.
Article 5 (Paid Services and Auto-Renewing Subscriptions)
Some features of the App are provided as a paid subscription (the "Service"). Prices and billing periods follow what is displayed on the App Store or Google Play.
The Service renews automatically. Unless you turn off auto-renewal at least 24 hours before the end of the current period, it renews automatically at the same price.
Payment is charged to your Apple ID or Google account when the purchase is confirmed.
To cancel (turn off auto-renewal), on iOS go to your device "Settings" > Apple ID > "Subscriptions"; on Android use "Subscriptions" in the Google Play app. The Company cannot directly manage billing or issue refunds; refunds follow Apple's or Google's policies.
Where a free trial or free tier is offered, its conditions follow the in-app display. If you do not cancel during a trial period, it may automatically convert to paid billing at the end of the period.
Article 6 (Prohibited Conduct)
In using the App, you must not:
violate laws, regulations, or public order and morals;
reverse-engineer, decompile, modify, or make unauthorized copies of the App;
improperly circumvent or interfere with the App's features;
infringe the rights of the Company or any third party.
Article 7 (Intellectual Property)
Intellectual property rights in the App and its related software, design, and trademarks (including "PosePause") belong to the Company or their rightful owners.
Article 8 (Disclaimer of Warranties)
The App is provided "as is," and the Company does not warrant that the App is fit for any particular purpose, is free of errors or interruptions, or that its judgments (pose recognition) are always accurate.
Article 9 (Limitation of Liability)
To the maximum extent permitted by law, the Company shall not be liable for any damage arising from your use or inability to use the App. Even where the Company is liable, the amount of compensation shall not exceed the amount you paid to the Company (or to Apple or Google) for the Service during the 12 months immediately preceding the event giving rise to the damage.
Article 10 (Indemnification)
If the Company incurs damage (including costs of responding to third-party claims and reasonable attorneys' fees) because you breached these Terms or used the App improperly or illegally, you shall indemnify the Company for such damage.
Article 11 (Suspension and Termination by the Company)
If you breach these Terms, or where there is a reasonable ground relating to the operation or maintenance of the App or otherwise, the Company may, without prior notice, suspend your use or change, interrupt, or terminate all or part of the App. The Company is not liable for any damage caused to you or any third party as a result.
Article 12 (Use by Minors)
If a minor uses the App, they must do so with the consent of a parent or other legal representative. The same applies to use of the paid Service involving billing.
Article 13 (Changes to These Terms)
The Company may change these Terms without prior notice to users when it deems necessary. The revised Terms take effect when posted on this page.
Article 14 (Governing Law and Jurisdiction)
The interpretation and application of these Terms are governed by the laws of Japan. In the event of a dispute between the Company and a user regarding the App, the Yokohama District Court shall have exclusive jurisdiction as the court of first instance.
